These Terms of Service ("Terms") govern your use of SoftPop (the "Game"), operated by Goofy Guy Games ("Goofy Guy Games", "we", "us", or "our").
By downloading or playing the Game, you agree to these Terms.
1. License
We grant you a limited, non-exclusive, non-transferable, revocable license to play the Game for personal, non-commercial use.
2. Accounts & platform services
The Game may use third-party platform services such as Google Play Games or Apple Game Center for leaderboards and sign-in. We do not control these services and are not responsible for their operation.
3. Points, progress, and player identity
Gameplay points, leaderboard entries, and related game progress may be associated with your Unity Authentication player identifier and/or other game-service identifiers used by the Game. These records are not the same thing as your Google, Apple, or platform account.
If you sign in with Unity Authentication, your points may follow that Unity player identity rather than a device-specific or external platform account. If you switch identifiers, clear app data, reinstall the Game, or otherwise lose access to the identity used by the Game, prior points may not transfer unless the Game explicitly supports account linking or migration.
4. In-app purchases
- The Game offers optional in-app purchases.
- All purchases are processed by Google Play or Apple App Store (the "Platform"). We do not process payments directly and we do not store payment card details.
- Prices, availability, and offered items may change, and may vary by country, currency, taxes, and Platform fees.
- Virtual items and currency have no real-world value and cannot be exchanged for real money or items outside the Game.
- Except where required by law or Platform policy, purchases are non-refundable. Refund requests must be submitted to the Platform through which you made the purchase.
- We may add, remove, modify, rebalance, or discontinue virtual items, currency, offers, and features at any time, including for gameplay, legal, technical, or business reasons.
5. Subscriptions (if offered)
If the Game offers subscriptions in the future, subscription purchases will be processed by the Platform and may automatically renew unless canceled through your Platform account settings. Prices, renewal terms, and cancellation options will be shown at the time of purchase and governed by the applicable Platform policies.
6. Ads
The Game contains advertisements. Ad availability, frequency, and format may change at any time. Where allowed by law and your settings, ads may be personalized; in regions requiring consent, ad partners may request consent or provide choices through an in-app prompt and/or device settings.
7. Promotions and pricing
We may offer limited-time promotions, discounts, bundles, or special items. Promotions may change or end at any time. If a pricing or listing error occurs, we may correct it and, where appropriate, remove or adjust the affected offer.
8. Mixed-audience and parental controls
SoftPop is a mixed-audience game. If you are a parent or guardian, you are responsible for supervising a minor's use of the Game, including controlling purchases and downloads through device and Platform settings (such as password requirements and parental controls).
9. Acceptable use
You agree not to:
- Cheat, exploit, or modify the Game
- Interfere with servers or services
- Use the Game for unlawful purposes
10. Suspension, termination, and chargebacks
We may suspend or terminate access to the Game at any time for violations of these Terms.
If we reasonably believe that fraudulent activity has occurred (including repeated chargebacks or payment disputes), we may limit, suspend, or terminate access to certain features (including purchased or granted virtual items) to protect the Game, other players, and our partners. Any refund or payment dispute must be handled with the Platform.
11. Disclaimer
The Game is provided "AS IS" and "AS AVAILABLE", without warranties of any kind.
12. Limitation of liability
To the maximum extent permitted by law, Goofy Guy Games shall not be liable for any indirect, incidental, special, or consequential damages arising from use of the Game.
13. Governing law
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
14. Changes to terms
We may update these Terms at any time. Continued use of the Game indicates acceptance of the updated Terms.
